The Constitution and The Supreme Court: Previewing the 2013 Term

In commemoration of Constitution Day on September 17, Vice Chancellor Ray Diamond and Professors Michael Coenen and John Devlin discussed and took questions from students on the major constitutional issues the Court is set to address, such as:

  • The meaning of the Recess Appointments Clause;
  • The scope of Congress’s powers to implement treaties;
  • The constitutional validity of statewide affirmative-action bans; and
  • First Amendment limits on government-sponsored prayer.

As part of the discussion, the professors discussed three cases pending before the U.S. Supreme Court: NLRB v. Canning, Schuette v. Coalition to Defend Affirmative Action and Town of Greece v. Galloway.
